Voucher Purchase
1.It is our intention that all the terms of the contract between us are contained in these Terms and Conditions and in the brochures and associated documents issued by us. These are our standard Terms and Conditions. Vouchers sold under special offers may have variations to these Terms and Conditions and any such variations will be published with such vouchers.

2.All purchases of a voucher for a scenic flight must be made on our standard forms or submitted electronically from our website. Vouchers may be purchased in person but you must also complete a booking form before flight agreeing to these terms.

3.This contract is made with you but you can give the flight voucher (on the terms of this Contract) to someone else. These Terms and Conditions will still apply and “you” in the rest of these Terms and Conditions will refer to that person.

4.The purchase of a flight voucher may be cancelled under Distance Selling Regulations. In this event you must at your expense return all the documents within 14 days of the date of purchase. The refund will be made to the person who paid for the flight voucher.

Our obligations to you
5.The voucher will entitle you to be carried as a passenger on a scenic flight, at a date to be arranged, within 12 months of its purchase, or such lesser special offer period as published. The voucher is not redeemable for cash.

6.Flights are weather dependent and are operated in accordance with the minimum specified conditions within our Operations Manual, and the requirements of the Air Navigation Order (ANO). We may postpone a flight at any time after assessment of the actual and/or forecast weather conditions to remain in compliance with our Operations Manual and the ANO. If we do, we will give you as much notice as our operational procedures will allow, but in order to ensure your safety, we reserve the right to postpone a flight at any time up to the planned dispatch time. If flights are suspended due to operational restrictions beyond the Company’s control, validity of reservations will be extended by the period of such restrictions.

7.As weather conditions may vary within a local area, the pilot has the responsibility for deciding the duration and conduct of any flight and the appropriate routing, duration and time of take-off and landing. We cannot guarantee that a flight will be over any particular ground feature, cover any particular distance or be at any particular height. The photographs in our leaflet and website are used for illustration purposes only.

8.If we have to postpone your flight on eight or more occasions and your voucher is then valid for a period of less than two months we will extend the validity period of the voucher to include the next three months of the main flying season which is April to October. If this extends the validity of the voucher into the main flying season of the next year, the voucher will also be valid for the intervening months. If the validity period of your voucher expires and you have not tried to fly on at least 8 occasions we will extend the validity period by a further 12 months for a fee of £30 per person. The provision of an extension does not affect your statutory rights and the standard Terms and Conditions apply.

9.We will make you a refund less our reasonable administration costs (see Clause 12.) in the following circumstances:

If you die or it is certified by a doctor that there is no possibility that you will be or are medically fit to fly (other than by reason of pregnancy) during the validity period of your voucher.

If we agreed in writing at the time of the voucher purchase that the flight must be taken on a specified date or within a specified period of time of not more than one month and we are unable to fly at the time.

10.If you are unable to fly during the validity period of your voucher because you are pregnant we will extend the validity period by 9 calendar months.

11.Refunds in any other circumstances are at our discretion.

12.Our administration costs are 40 per cent of the voucher price and this percentage represents a reasonable aggregate of our administration costs per passenger.

13.Aerial activities intrinsically involve the possibility of physical risks greater than those encountered in daily life even though they are conducted under the supervision of commercial pilots who exercise all due precautions to ensure safety. By taking part in such aerial activities, passengers are understood to be fully aware of these risks.

14.We carry insurance cover for any legal liability we may be found to have to you for any injury you may sustain, or for damage sustained by your belongings during the course of flight, or during embarkation or disembarkation. However English law in some circumstances sets maximum limits on our legal liability to you that you might regard as inadequate to compensate for any loss, whether for death or personal injury or damage to your personal belongings. The combined single limit third party and passenger liability insurance cover for each of the company’s aircraft is in accordance with current European legislation covering commercial air transport. We can provide further details upon request and if you do not consider that the amount of insurance cover would be adequate to compensate you for any loss whether for death personal injury or damage to your belongings you should take out your own additional cover. We will not be liable for any loss or damage to equipment and effects brought with you on the flight nor for death or personal injury above the level of our insurance cover unless it has been caused by our recklessness.

15.We do not accept liability for any costs or expenses you incur if we have to postpone any flight, where the reason for the postponement is beyond our control.

16.Vehicles and their contents are left at airfield passenger facilities at your risk and no liability is accepted for any loss or damage to your vehicle or contents unless it is due to our negligence.

Your obligations to us
17.Your voucher is valid for a period of 12 months from the date upon which it was bought, or such lesser special offer period as published. The expiry date is shown on the voucher. If your flight is not taken within that time you will lose the right to participate in a flight unless you have booked flights on eight occasions during the main flying season, which have had to been postponed for operational reasons or the validity period of the voucher has been extended for some other reason under these Terms and Conditions.

18.You must contact us within 3 months of the purchase of the voucher to discuss booking your flight which must be for a date within 9 months of the purchase date and in the main flying season. If you do not do so and do not take your flight within the validity period, the voucher will expire at the end of its validity period and you will lose the right to a flight. We will not make any refund in these circumstances.

19.It is the responsibility of the passenger to make contact to rebook a postponed flight. In the event of a flight being cancelled due to adverse weather conditions or for any other reason, the current range of alternative dates will be available on enquiry.

20.You must telephone the weatherline to check that the flight has not been affected by adverse weather conditions in accordance with our instructions.

21.You may postpone your flight up to 36 hours before the booked time for the flight which you have booked if your flight has been booked for a day between Monday to Friday inclusive and up to 72 hours before the booked time for a flight which you have booked if your flight has been booked for Saturday or Sunday. A message left on an out of hours answering machine, or that is sent by fax or by e-mail is not acceptable as a method of postponement.

22.If you do not give notice of postponement in accordance with clause 21. above or do not attend in time to take part in your booked flight, you will not be entitled to a re-scheduled flight nor to any refund.

23.We are not qualified to express an opinion confirming that you are fit to fly and you must ensure that you are fit to fly. You must not fly if you are suffering from any serious medical condition, or have recently undergone surgery. We may ask you to provide us with a certificate of your fitness to fly from your doctor or specialist. You must not fly if you are pregnant or under the influence of alcohol and/or drugs.

24.Our paramount consideration is your safety and the safety of others participating in the flight and you must obey all requests and instructions issued by any of our representatives including ground crew and flight crew and take particular care to abide by any safety instructions given. The pilot has complete discretion as to whether to allow you to take part in the flight and will refuse to allow you to do so if in his opinion you would be a risk to the aircraft, to other passengers or to yourself. In these circumstances you will lose your entitlement to a flight.

25.You should wear appropriate clothing as is advised to you in advance of the flight.

26.Smoking is not permitted in any part of our airport premises, near or on board any aircraft.

27.Hand baggage is not permitted on flights, except that small cameras and binoculars may be carried.

28.Passengers will be asked to ensure that no prohibited or dangerous articles are taken on board the aircraft, in particular lighters and matches are not permitted.

Conditions of Carriage of Adults, Children and Persons of Reduced Mobility
29.Our Operations Manual permits us to fly children over the age of 6 years and whose height exceeds 1 metre. A child under the age of 16 years may only be flown if accompanied by a responsible adult appointed by the parent(s)or guardian. The responsible adult must be booked onto the same flight using a valid voucher.

30.In the interests of safety and operational requirements we cannot undertake the carriage of passengers whose declared weight exceeds 18 stone (114kg, or 252lbs).

31.Our Operations Manual permits persons of reduced mobility to be carried, who are able to embark and disembark the aircraft unaided, and provided we are able to fulfil other operational conditions contained in our Operations Manual. We are committed to ensuring that customers have the opportunity to fly, so we require that you tell us about any disability or medical condition, even if YOU do not consider that it is a disability, at the time of ordering. Such information is needed to allow us to respond to our duty of care for your safety. This also enables us to consider the conditions of our Operations Manual and make special arrangements if possible, to meet your particular needs.

General
32.If we are unable to provide the service for whatever reason then we may terminate the contract. We cannot be held liable for any of the client’s losses or costs of whatever nature that result from the cancellation.

33.Avon Air Centre Limited reserves the right to change these terms from time to time without reference to customers.

34.Unless specifically provided for in these Terms & Conditions, no third party shall have any rights under or in connection with these Terms and Conditions.

35.The provisions of these terms and conditions are separate, and if any provision or part of it is held to be invalid or unenforceable by any court or other body of competent jurisdiction, that will not affect any other provisions or the remainder of the relevant provision.

36.This agreement shall be construed, interpreted and applied in accordance with the Laws of England and Wales and subject to the jurisdiction of its courts.
